In order for a stepparent to be able to adopt a stepchild, the rights of the non-custodial biological parent need to be terminated.
A biological parent’s rights are automatically terminated upon death, or a court can terminate them voluntarily or involuntarily. After the termination of the non-custodial biological parent’s rights, a Petition for Adoption can be filed in the county where the Petitioners reside.
Details on your specific stepparent adoption can be discussed in a consultation with one of our attorneys.

While you may have heard that adoption is extremely expensive, the primary expense in most adoptions are the fees charged by adoption agencies. These fees are typically for locating a child available for adoption, and for the medical, psychological and living expenses for the biological mother.
As Texas allows for “independent adoption”, the use of an adoption agency is not mandatory. Person to person or family to family adoptions can occur. These adoptions are significantly less expensive. We are happy to consult with you about your options and to help you find the most cost-effective option for your family.
